1. The complainant Sh. V.K. Gupta, the then Assistant Registrar of Companies, NCT of Delhi & Haryana filed the present complaint against the accused for the offence U/s 146 punishable under Section 146 (4) of the Companies Act, 1956 (for short 'Act').
2. Succinctly, the facts of the case are that M/s. Shree Industries Ltd. (hereinafter referred as 'company') is registered with the office CC No. 291749/2016 ROC Vs. M/s. B.L. Rathi Page 1 of 4 of the complainant and accused is the officer in default and is responsible / liable for compliance to the provisions of Section 146 (2) of the Act. It is further stated in the complaint that complainant filed a complaint against other Directors namely Ravi Mittal, Sandeep Mittal and Kumkum Mittal and after filing the said complaint, it was noticed that name of the present accused was also appearing in the annual return. It is further stated in the complaint that company failed to maintain its registered office at the address notified to the office of the complainant and accused being the Director of the company at the relevant point of time is liable for the penalty as contemplated under Section 146 (4) of the Act. Hence, the present complaint.
