1. An eviction petition has been filed by the petitioner Sh. Nitin Jain against the respondent / tenant Sh. Lalit for vacation of the tenanted premises, i.e., Two rooms on backside of property bearing No. 10924, Manak Pura, Sheedipura, Doriwalan, New Delhi, as shown in colour red in the site plan annexed alongwith the petition on the ground of bonafide requirement under Section 14 (1) (e) of the DRC Act (hereinafter referred to as the 'DRC Act').
2. The case of the petitioner is that the petitioner is the GPA holder of Sh. Jai Prakash Jain son of late Sh. Nem Chand Jain vide GPA dated 23.04.1985. That S. Inder Singh was exclusive owner and in possession of the property bearing No. 10924, Manak Pura, Sheedipura, Doriwalan, New Delhi with the lease hold rights of the Page No. 2 of 10 E No. 03/17 3 land by way of registered sale deed dated 30.07.1970. That S. Inder Singh had inducted Sh. Ganpat as tenant with respect to two rooms on the backside of the property in question. At present the LRs of Sh. Ganpat, i.e., respondent is having possession over the tenanted premises. That S. Inder Singh had transferred all right of ownership and possession in respect of property No. 10924/14, Doriwalan, Manak Pura, Delhi in favour of the petitioner Sh. Nitin Jain by executing agreement to sell and purchase, affidavit, registered receipt, registered will all dated 23.04.1985. Thereafter, Sh. S. Inder Singh had executed the registered GPA dated 23.04.1985 in favour of the petitioner as well. That the petitioner after purchasing the property had informed the respondent about the change of landlordship. However, the respondent neither paid rent to the petitioner at any point of time.
